These Terms & Conditions apply to all orders placed through the Jelly Up website, WooCommerce store, and online ordering channels.

By placing an order, you confirm that you agree to these Terms & Conditions.
We operate in accordance with consumer protection laws in the EU and Ireland.


🍰 2. Products

We sell handmade cakes and dessert products, including cakes with jelly and fresh ingredients.

Because all products are handmade:

  • Appearance may vary slightly,
  • Colours and decoration may differ slightly from photos,

All products are made fresh to order.


⏳ 3. Orders & Production Time

All products are made fresh to order.

Standard production time is 3 days (72 hours) from order confirmation and payment.

For this reason:

  • Next-day collection is not available,
  • Next-day delivery is not available,
  • Orders must be placed at least 3 days in advance,

Orders are confirmed only once payment is successfully received.

We reserve the right to cancel orders due to:

  • Product unavailability,
  • Pricing errors,
  • Suspected fraud,

If we cancel your order, you will receive a full refund.

Order confirmation is sent by email.


πŸ’³ 4. Pricing & Payment

All prices are listed in EUR and include VAT where applicable.

Delivery charges (if applicable) are shown at checkout.

Accepted payment methods:

  • Card,
  • Online payment providers,
  • WooCommerce integrated payment gateways (where available),

🚚 5. Delivery

We deliver to selected areas only.

Free delivery is available only within Galway city limits.

Delivery outside Galway city may be subject to additional delivery charges.

Estimated delivery times are not guaranteed.
We are not responsible for delays caused by third-party couriers or circumstances outside our control.

Customers must ensure someone is available to receive the order.

Once delivered, responsibility for correct storage passes to the customer.


πŸ“¦ 6. Collection Policy

Collection is available only at the scheduled date and time agreed at checkout or via written confirmation.

Customers must:

  • Arrive at the agreed collection time,
  • Transport cakes safely (flat surface, temperature control recommended),

If a customer is late:

  • We will hold the order for a reasonable time period where possible,
  • We are not responsible for product quality if collection is significantly delayed,

If a customer fails to collect:

  • Refunds may not be issued for perishable goods,
  • We reserve the right to dispose of uncollected orders after a reasonable time,

Once collected, responsibility for storage and transport transfers to the customer.


πŸ’’ 7. Wedding & Event Orders

For wedding or large event orders:

Deposits

  • A non-refundable deposit may be required to secure the booking date,

Final Payment

  • Final balance must be paid before production begins (unless agreed otherwise in writing),

Changes

  • Design or size changes must be requested before production begins,
  • Changes may not be possible once production has started,

Cancellations

  • Deposits are non-refundable,
  • Additional refunds may not be available once production has started,

Set-Up & Delivery (if applicable)

  • We are not liable for venue delays or venue storage conditions,
  • The customer is responsible for providing correct venue access and timing,

🧾 8. Perishable Goods, Production Time & Cancellation Rights

Under EU consumer law, customers usually have a 14-day cooling-off period for online purchases. However, this right does not apply to:

  • Perishable goods (including fresh cakes and desserts),
  • Custom-made or personalised products,

Because all products are made fresh to order and require a minimum 3-day production period:

  • Orders may be cancelled only before production begins,
  • Production typically begins shortly after order confirmation,
  • If the order was placed in advance (more than 3 days before the delivery) production begins in the time required for the production process,
  • Once production has started, cancellations and refunds may not be possible,

If your product is faulty, damaged, or not as described, you may still be entitled to a replacement or refund under consumer law.

To return your product, you should mail your product to: {physical address}.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you may vary.

If you are returning more expensive items, you may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.


❌ 9. Faulty, Damaged or Incorrect Orders

If your order arrives damaged, incorrect, or not as described:

  • Contact us within 24 hours,
  • Provide photos of the product and packaging,

If confirmed, we may offer:

  • Replacement,
  • Refund,
  • Partial refund,

Our products may contain:

  • Gluten,

or come into contact with:

  • Milk,
  • Peanuts,
  • Sesame,
  • Soy beans,
  • Tree nuts,

May contain Sulphites as carry-over.

Ingredients from colours we are using:

  • E102 (Tatrazine),
  • E122 (Carmoisine),
  • E124 (Ponceau 4R),
  • E129 (Allura Red AC),

E102, E122, E124, E129 May have adverse effect on activity and attention in children.

Customers must inform us of allergies before ordering.

We cannot guarantee a completely allergen-free environment.


❄ 11. Storage & Product Care

Cakes and desserts must be refrigerated unless otherwise advised.

We are not responsible for:

  • Incorrect storage after delivery or collection,
  • Damage after delivery or collection,
  • Consumption without recommended storage instructions,
  • Consumption after date of use,

βš–οΈ 12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

  • Delays outside our control,
  • Customer failure to follow storage instructions,
  • Undisclosed allergies,

Nothing in these Terms removes statutory consumer rights.

Customer data is processed according to GDPR and our Privacy Policy.

These Terms are governed by the laws of Ireland.
Any disputes will be handled by Irish courts.

❗ 17. Failed Delivery

If delivery cannot be completed due to customer-related issues, including but not limited to:

  • Incorrect delivery address provided,
  • Customer unavailable at delivery time,
  • Customer not responding to delivery contact attempts,
  • No safe access to delivery location,

The following may apply:

  • Re-delivery may be subject to additional delivery charges,
  • Refunds may not be issued for perishable goods,
  • We are not responsible for product quality if delivery is delayed due to failed delivery attempts,

If delivery fails and redelivery is not possible within a safe timeframe for perishable goods, the order may be considered completed.


🌑️ 18. Weather & Summer Temperature Disclaimer

Due to the nature of fresh cakes, jelly desserts, and temperature-sensitive ingredients:

  • Products must be stored in refrigeration unless otherwise advised,
  • Products should not be left in warm environments, cars, or direct sunlight,

During warm weather periods or higher summer temperatures:

  • Customers must ensure appropriate storage immediately after delivery or collection,
  • We are not responsible for melting, texture changes, or structural damage caused by heat exposure after delivery or collection,

For events, customers are responsible for ensuring the venue provides appropriate storage conditions.

We reserve the right to recommend adjusted delivery or collection times during extreme weather conditions to protect product quality.
